Public Records Access and Legal Framework

Most court records in Worcester County are public under M.G.L. c. 66, § 10. This law gives any person the right to inspect public records held by government agencies, including court clerks. You do not need to explain why you want the records or have any particular legal standing. The clerk may charge standard copy fees, but you have the right to inspect documents for free in person at public access terminals.

Some records are not public. Cases involving juveniles, adoptions, sealed criminal records, and expunged records are restricted. Criminal records may be sealed under M.G.L. c. 276, § 100A after a waiting period following a case's resolution. Expungement is available for certain offenses under M.G.L. c. 276, §§ 100E-100U. When a record is expunged, the clerk cannot confirm it ever existed.
